OPEN LISTING AGREEMENT

 

Note: We are not accepting any listings that will have a gross selling price of less than $35,000

1.       I, owner of the vessel , number , grant Mac Donald Yacht Brokerage (hereinafter called LISTING BROKER), the right to sell or exchange the above named vessel from this date to and including for the price and terms stated herein, or for such other price and terms acceptable to me.  It is understood and agreed that this Listing Agreement shall supersede all other Listing Agreements now in effect.  It is understood and agreed that this Listing Agreement is an Open Listing, and that I may list the subject vessel with other brokers on an Open basis, or sell the vessel myself without obligation to Listing Broker.  (Subject to the agreement stated on Paragraph 3.)

2.  I grant LISTING BROKER, his agents and assigns, the right to board and show said vessel, and hereby agree to hold same free from liability for any loss whatsoever, including, but not limited to, any loss by fire, theft, storm, or act of God.  It is expressly understood in connection herewith that LISTING BROKER          does not assume care, custody or control of said vessel.

3.  I agree to pay LISTING BROKER a commission of 10% of the gross selling price (or exchange value), or a minimum of $2500 for boats kept at Cabrillo Isle Marina and $3500 for boats kept elsewhere, in the event of any sale or exchange of the above named vessel by Mac Donald Yacht Brokerage during the listing period.  The listing price of the vessel shall be the same as the owners advertised price, regardless of all or any price reductions.  In the event the vessel is sold or exchanged within six months after the expiration of the listing period to a previously registered prospective Buyer of the LISTING BROKER, LISTING BROKER             shall receive full commission stated herein.  In consideration thereof, owner will notify LISTING BROKER of the identity of any purchaser, prior to the sales of said vessel, for a period of six months following the termination of the Listing Agreement.

4.       I certify that I am the owner of the above named vessel and have the right to sell same;  that All information given by me is correct; that this Agreement contains all the agreements of the parties; that no representations or warranties have been made to me except as are set forth herein; and that I have read the foregoing and agree to the terms thereof.

6.  Receipt of a copy of this Listing Agreement is hereby acknowledged by , Seller.

7.  I agree to provide Broker with a copy of Official Documentation or State Registration

8.  Property Tax will not be pro-rated between Buyer and Seller.  Please keep this in mind when negotiating final selling price
